“SAN MARINO SONG CONTEST”

MUSICAL COMPETITION CONNECTED TO THE EUROVISION SONG CONTEST – 2025/2026 EDITION

Whereas:

  1. The Segreteria di Stato per il Turismo, Poste, Cooperazione ed Expo della Repubblica di San Marino (hereinafter, for brevity, the “Segreteria di Stato”), the Radiotelevisione della Repubblica di San Marino (hereinafter, for brevity, “San Marino RTV”), and Media Evolution S.r.l., with registered office at Via III Settembre no. 99, Republic of San Marino, SM 47890, C.O.E. SM 29275 (hereinafter, for brevity, “ME”), have agreed to implement a music competition, developed in multiple phases, using digital channels for pre‑selection purposes and in‑person events within the Republic of San Marino, in order to identify the Winner to be entered, on behalf of San Marino RTV, in the Eurovision Song Contest 2026.

San Marino RTV, in its capacity as a member of the EBU, has the right to register one Artist for the Eurovision Song Contest, representing the Republic of San Marino.

  1. В Segreteria di Stato, in agreement with San Marino RTV, entrusts ME with the organization of the initial phases of the San Marino Song Contest called “Dreaming San Marino Song Contest” (eligibility verification/registrations, casting, stage & live academy), while San Marino RTV organizes and produces the two Semi‑Finals and the Final called “San Marino Song Contest”, also taking care of television broadcasting and of registering the Winner for the Eurovision Song Contest 2026.
  2. ME has expressed its intention to continue the activities of planning, organizing and carrying out the initial phases of the San Marino Song Contest (called “Dreaming San Marino Song Contest”). ME is tasked with drafting, for the initial phases of the San Marino Song Contest called “Dreaming San Marino Song Contest”, a General Regulation, in line with the Eurovision Song Contest Regulation, setting out and governing the general conditions for registration, the selection conditions and all provisions necessary to ensure the regularity of the phases of the Contest: the Prize for the Winner of the San Marino Song Contest (or for the next ranked participant should the Winner renounce) shall be registration for the Eurovision Song Contest 2026, to be carried out by San Marino RTV.

SAN MARINO RTV shall, in particular — in line with the public–private synergy agreement — be responsible for the technical‑artistic direction, production, organization, administrative management, logistics and distribution:

a) No. 2 (two) Semi‑Finals with the indicative participation of 20 (twenty) competitors each (up to 40 in total);

b) в Final of the San Marino Song Contest (with television broadcast).

  1. В Segreteria di Stato а также San Marino RTV, together with ME, intend to develop a competition that enables any citizen worldwide, of any nationality and any language, to participate, win and access the Eurovision Song Contest 2026.

San Marino RTV operates through its single television channel 550 (Digital Terrestrial – Tivùsat – Sky), as well as via radio and its official digital and social platforms, ensuring comprehensive, multi‑channel coverage of the San Marino Song Contest.

The procedure for identifying the competitor who will access the Eurovision Song Contest 2026 is divided into two phases: the first called “Dreaming San Marino Song Contest” and the subsequent one called “San Marino Song Contest”, with television coverage, under the aegis and organization of San Marino RTV, providing for two Semi‑Finals and the Final with the proclamation of the Winner.

  1. With these Regulations for the 2025/2026 edition, ME governs the methods of registration–access–selection for the phases called “Dreaming San Marino Song Contest” aimed at the implementation of the San Marino Song Contest, whose Winner shall have the right to access, upon presentation by San Marino RTV, the Eurovision Song Contest 2026.

These Regulations specifically concern the initial phases of the Contest called “Dreaming San Marino Song Contest”, organized by ME, which determine the selection of the 40 (forty) competitors admitted to the two Semi‑Finals of the San Marino Song Contest, organized and produced by San Marino RTV. The Semi‑Finals will select 10 (ten) competitors (5 for each Semi‑Final) who will access the Final of the San Marino Song Contest, in which the competitors thus identified will compete publicly together with any artists invited by San Marino RTV. A qualified Jury, appointed by San Marino RTV, will designate the Winner of the San Marino Song Contest, who shall have the right to represent the Republic of San Marino at the Eurovision Song Contest 2026.

All the foregoing being stated,

in compliance with the agreements referred to above and in full harmony with the aforementioned entities, adopts, for the 2025/2026 edition of the San Marino Song Contest, the following

REGULATIONS

Art. 1 – COMPETITORS

As of today, all natural persons who, by 30/09/2025, have reached the age of sixteen (16) may apply to register for the Dreaming San Marino Song Contest by submitting the relevant registration application (hereinafter “Competitors”), either as solo performers or as musical groups with a performer (for example, duo, band, etc.). Registrations will end on 20/01/2026.

For minors, the consent to and signature of the registration by the parents exercising parental authority are required; they hereby undertake to cooperate actively in obtaining the authorization required for the performance of minors in the Dreaming San Marino Song Contest, by signing, for this purpose, the consent form and any necessary document and/or request: the issuance of the authorization by the competent Office is a condition for participating in all phases of the Dreaming San Marino Song Contest.

The parents (including only one of them where only one is present) and/or the guardian, if appointed by the judicial authority competent in the matter (hereinafter also referred to as the parent), shall be solely responsible for any presence, act and/or behavior of their children within the scope of the activities of the San Marino Song Contest, holding ME, San Marino RTV and the Segreteria di Stato harmless.

Art. 1 BIS – Wild Card for Competitors resident in San Marino

All artists resident in the Republic of San Marino may register for the Dreaming San Marino Song Contest and participate in the selections, as provided in Art. 2 below, on the same basis as other Competitors.

If no San Marino Competitor is selected to access the Final of the San Marino Song Contest referred to in Art. 2, letter e) below, ME shall assign, to the highest‑ranked among the excluded San Marino Competitors, a Wild Card, enabling him/her to access directly the Final of the San Marino Song Contest.

Art. 2 – THE SAN MARINO SONG CONTEST PATHWAY

In order to proclaim the Winner of the San Marino Song Contest, Competitors must complete the following pathway:

A) Phase “Dreaming San Marino Song Contest” (under ME’s responsibility)

  1. Eligibility Verification/Online Registration on the website https://dreamingsanmarinosongcontest.com/ (hereinafter, for brevity, the “Website”) with a request for Eligibility Verification;
  2. Кастинг to be carried out over the course of one day;
  3. Stage & Live Academy: training and selection phase for the 40 (forty) Competitors who will access the 2 (two) Semi‑Finals (20 for each Semi‑Final).

B) Phase “San Marino Song Contest” (under San Marino RTV’s responsibility)

  1. 2 (two) selection Semi‑Finals, produced and broadcast by San Marino RTV, upon the outcome of which 5 (five) Competitors from each Semi‑Final will access the Final;
  2. Final of the San Marino Song Contest, organized and broadcast by SAN MARINO RTV, during which the Winner will be proclaimed who, with the song performed in the Final, will be registered by San Marino RTV for the Eurovision Song Contest 2026, subject to verification of all eligibility requirements.

All documentation relating to the Dreaming San Marino Song Contest phase (under ME’s responsibility) will be kept on file for 3 (three) months from the end of the Final.

a) ELIGIBILITY VERIFICATION – ONLINE REGISTRATIONS (ME)

Eligibility Verification is free of charge and is aimed solely at verifying the eligibility status of each Competitor for the competition through an assessment conducted by an industry expert, chosen at ME’s sole discretion, who will express a positive or negative judgment. It is understood that even in the event of a negative outcome, the Competitor may register for the Casting.

Eligibility Verification shall start as of today, end on 17/01/2026 and be conducted online by submitting to ME a specific form available on the Website in the section “Eligibility Verification: online form”, through which the required materials may be sent (video links and/or mp3 files) as specified in the same section.

b) CASTING (ME)

This phase shall be held in San Marino at a venue to be designated by ME, indicatively in the Event Hall of the San Marino Outlet Experience in Falciano, Str. degli Angariari no. 41, and shall consist, indicatively, of multiple sessions each lasting 1 (one) day.

The sessions will be published on the official Website of the Dreaming San Marino Song Contest and shall constitute final notice to the Competitors.

The Casting consists of a selection phase through a private audition, on a live backing track (half playback), and assessment by the Jury accredited and appointed by ME, which will admit to the subsequent Stage & Live Academy phase indicatively 240 (two hundred and forty) or more Competitors, it being understood that ME reserves the decision regarding the exact number. The session will be recorded by ME.

The Jury’s decision is final. In particular, the Competitor, also at the time of Casting, must formally notify ME of any fact, element, circumstance, relationship or other that may, in whole or in part, constitute even indirectly a cause of influence on the Jury, or any of its members or anyone in ME’s organization, over the Jury’s vote, which must be free and based on meritocratic artistic evaluations according to the personal conviction of the judge. Any past participation of the Competitor and/or of the judge and/or of a member of the organization in other contests/festivals must be disclosed by both the Competitor and the Juror for the replacement of the Juror, given the trend of Competitors participating in multiple contests/festivals. The foregoing shall apply to all phases of the Dreaming San Marino Song Contest.

Only for Competitors residing in countries not bordering Italy, Casting may be conducted, upon the Competitor’s request, by means of remote connection according to the procedures and on the dates that will be determined at ME’s sole discretion and communicated to the requesting Competitor by electronic mail.

For the sake of clarity, the countries bordering Italy are: Switzerland, France, Austria and Slovenia.

c) STAGE & LIVE ACADEMY (ME)

The Stage & Live Academy (also “LA”) will indicatively be held in four sessions starting from February 2026 according to a calendar published at ME’s sole discretion on the Dreaming San Marino Song Contest Website; the last session will take place with an end date of 25/02/2026; it is reiterated that all will take place according to a calendar that will be decided at ME’s sole discretion and communicated to the Competitors by publication on the Website in the dedicated “Stage & Live Academy” section.

The LAs are aimed at the performance, after the Academy, of the Competitor before the Jury chosen at ME’s sole discretion, which will judge and evaluate the participants and their song.

The LAs shall be 8 (eight), each of approximately 30 (thirty) Competitors; from each, 5 (five) Competitors will access the Semi‑Finals. The total Competitors admitted to the two Semi‑Finals referred to in letter d) below shall be 40 (forty), i.e., 20 (twenty) for each Semi‑Final.

d) SEMI‑FINALS (San Marino RTV)

Phase reserved for Competitors selected by the Jury at the outcome of the LAs.

The Semi‑Finals will be held in San Marino indicatively on 03/03/2026 and 04/03/2026.

Competitors will compete against each other, on a live backing track (half playback) before the public and a qualified Jury composed of industry experts chosen at the sole discretion of San Marino RTV, which produces and broadcasts the two Semi‑Finals.

The Jury’s evaluation is final, given and publicly reasoned at the end of the performance, based on criteria of artistic merit, originality and interpretative‑executive ability of each Competitor.

There are 2 (two) Semi‑Finals.

The Jury will determine those admitted to the Final.

The Competitors selected from the Semi‑Finals will participate in the Final, during which they will compete among themselves and with Artists invited and selected by San Marino RTV. The Jury will admit to the Final indicatively 10 (ten) Competitors, i.e., 5 (five) Competitors for each of the two Semi‑Finals.

It is understood, and all parties acknowledge, that minors may not perform in either the Semi‑Finals or the Final after 24:00; therefore, in the event that the Competitor passes the initial selection phases provided for, he/she may not participate in the subsequent ones if they are after said 24:00; in such event, audio‑video recordings of the Competitor will be used.

e) FINAL OF THE SAN MARINO SONG CONTEST (San Marino RTV)

The Final will indicatively take place on 07/03/2026 at the Teatro Nuovo Dogana or another venue decided by San Marino RTV in agreement with ME.

The date of the Final may be changed for reasons of San Marino RTV’s non‑appealable scheduling needs.

10 (ten) Competitors (5 for each Semi‑Final) will access the Final, in addition to any San Marino Competitor referred to in Art. 1 BIS.

f) CONTESTANTS SELECTED BY SAN MARINO RTV
San Marino RTV reserves the right, at its sole and unquestionable discretion, to select up to nine (9) Contestants for projects of particular artistic and musical relevance and interest, one of whom shall be identified in collaboration with and chosen by NO NAME RADIO Powered by RAI.
In the event that one or more of the aforementioned Contestants are selected at the discretion of San Marino RTV, they may access the Final — in addition to the ten (10) Finalists identified pursuant to paragraph (e) above, as well as the possible Sammarinese Contestant referred to in Article 1 BIS — without the need to take part in the previous phases of the San Marino Song Contest, while remaining subject to the obligation of registration and full acceptance of this Regulation.

An essential condition for accessing the Final is the full, non‑negotiable and non‑disputable execution, within 3 (three) days from the conclusion of the Semi‑Finals, of all statements of warranty concerning solvency and project capacity (in the event of victory) for participation in the Eurovision Song Contest 2026; Competitors must demonstrate adequate financial capacity and the availability of a high‑quality phonographic and publishing company, or, for self‑productions, project conditions of quality and concrete feasibility, as agreed between San Marino RTV and the Segreteria di Stato.

A Competitor deemed unsuitable may not access the Final.

ME may submit to the Competitor a contractual proposal (subject to eventual victory) aimed at ensuring solvency and project quality for proper participation in the Eurovision Song Contest 2026; such proposal must be accepted and signed by the Competitor and/or the authors of the competing song and/or producers and/or any right holder, by and no later than 28/02/2026, under penalty of forfeiture of participation in the Final.

In the Final, Competitors must perform the same original song performed in the Semi‑Finals.

В Winner will be proclaimed by a Jury of experts composed of 5 (five) members chosen at the sole discretion of San Marino RTV (one of whom shall serve as President).

В Winner of the San Marino Song Contest, with the song performed at the Final, will be registered by San Marino RTV for the Eurovision Song Contest 2026, subject to verification of all eligibility requirements.

В Winner of the San Marino Song Contest undertakes, also on behalf of third parties, now for then, to sign and cause to be signed any and all documents required for participation in the Eurovision Song Contest 2026, as full acceptance and acknowledgment with the obligation of full and total performance, such as the 2026 license agreement between the holder of the rights over the audio‑video recording of the song performed at the Final and the phonographic company decided by the Eurovision Song Contest, which will at the same time be published on the Website for the Competitors’ full knowledge, who in any case hereby confirm that they have taken note of the 2025 license, which will indicatively be valid for 2026, and whose execution is a requirement for participation in the Final of the San Marino Song Contest.

The Winner of the San Marino Song Contest undertakes, also on behalf of third parties, now for then, to comply with all the rules, commitments and conditions provided for in the Regulation of the Eurovision Song Contest 2026.

Art. 3 – REGISTRATION FOR THE DREAMING SAN MARINO SONG CONTEST

All those who meet the requirements set forth in Art. 1 may register for the San Marino Song Contest from today until 31/01/2026, regardless of whether they have carried out the (non‑binding) Eligibility Verification.

All registration forms are published on the Dreaming San Marino Song Contest Website in the “Registrations” section.

Incomplete/unsigned applications or those lacking proof of payment of the fees will not be accepted.

For minors, in addition to their own registration, the signature of the parents exercising parental authority is required.

3.1 CASTING (ME)

All those who wish to register for the Casting phase, whether in person or via remote connection if the conditions set forth in Art. 1 above apply, must submit the relevant registration application, after payment of the registration fee set at:

• Euro 150.00 (Euro one hundred and fifty/00), including VAT, both for individuals and for groups;

Payment of the registration fees, which is an essential condition for the registration itself, may be made by bank transfer to the account of Media Evolution S.r.l., with registered office at Via III Settembre no. 99, Republic of San Marino, SM 47890, C.O.E. SM 29275, in the person of the Sole Director Mr. Denny Montesi, to the following coordinates:

Note for transfers from the SEPA area (European Union):
San Marino is part of the SEPA area; therefore, the transfer can be made as a standard SEPA transfer, with no additional international fees, by selecting San Marino (SM) as the country.

3.2 STAGE & LIVE ACADEMY (ME)

All those who obtained a positive outcome from the Casting phase may register for the subsequent Stage & Live ACADEMY phase, within and no later than 3 (three) days from the aforementioned assessment and by paying the fee of Euro 150.00 (Euro one hundred and fifty/00), including VAT, which constitutes a condition thereof.

If registration is not completed within the aforementioned 3 (three)‑day period, the Competitor forfeits the possibility of registering for the Stage & Live ACADEMY phase.

For San Marino citizens/groups the registration is single and is set at Euro 50.00 (Euro fifty/00) provided it takes place by the deadline of 31/01/2026.

The registration application for the Stage & Live ACADEMY phase is published on the Contest website and payment of the provided fee, which constitutes a condition of validity, must be made to ME’s bank account.

3.3 SEMI‑FINALS / FINAL (San Marino RTV)

No registration fee is envisaged for the Semi‑Finals phase and none for the Final.

Art. 4 – THE MUSICAL WORKS

At the time of participation in each phase of the Contest, the Competitor shall deliver 2 (two) songs and, for each of these, the instrumental backing tracks (instrumental only) and, for the same songs, also 2 (two) complete backing tracks (music and vocals) with a maximum duration of 3 (three) minutes.

The musical bases (half playback) must be delivered in WAVE file format of adequate quality, specifying the Competitor’s first and last name, as well as the titles of the songs submitted with their order of performance.

By signing these Regulations, the Competitor consents to the musical bases delivered to ME not being returned and being deleted and/or destroyed after the conclusion of the Contest.

It is understood that, since the purpose of the Contest is to identify the Winner who will represent San Marino RTV at the Eurovision Song Contest 2026, the aforementioned songs must be in line with such purpose.

4.1 CASTING

The songs may be 2 (two), in the language freely chosen by the Competitor, on a half‑playback backing track freely chosen by the Competitor.

The duration of each song on a half‑playback backing track may not exceed 3 (three) minutes and, if longer, may be faded out during the audition.

4.2 STAGE & LIVE ACADEMY

There shall be only one song, in a language freely chosen by the Competitor, and it must mandatorily be the original song (Art. 5) intended to be submitted to the Eurovision Song Contest 2026.

The total duration of the performance, on half‑playback, must not exceed 3 (three) minutes maximum (the duration envisaged for Eurovision Song Contest songs) and, if longer, will result in the exclusion of the Competitor.

4.3 SEMI‑FINALS/FINAL

There shall be only one song and it must mandatorily be the original song presented at the Stage & Live ACADEMY.

The duration of the live performance must not exceed 3 (three) minutes maximum (the duration envisaged for Eurovision Song Contest songs) and, if longer, will result in the exclusion of the Competitor.

Art. 5 – DEFINITION OF COVER AND ORIGINAL WORK

With reference to the songs to be submitted to the Contest, the following shall mean:

A) By cover song: a musical work previously performed and published by another Artist of clear renown who is the original performer. By published it is meant a song presented and used in any form and/or manner, including making it available to the public, even free of charge (e.g., the internet), and/or used in another competition.

B) By original song: a song that, as of 01 September 2025, has never been performed and/or executed and/or used by the same Competitor and/or another Artist, in any form and/or manner, and which has not already been published, duplicated, marketed and/or broadcast via radio and/or TV and/or used in another competition, nor available as a recording in shops and/or on the web (YouTube) and/or on any website and/or in digital and/or streaming form, in line with the Eurovision Song Contest Regulation established by the European Broadcasting Union (EBU) and approved by the competition’s governing body, the Reference Group: it is acknowledged that if the EBU Regulation sets a date, for the definition of original song, subsequent to 01/09/2025, that shall be the binding date and, as such, shall be imperatively incorporated and valid in these Regulations.

Art. 6 – CONDUCT

The Competitors acknowledge the significant importance of the Contest, which involves the Segreteria di Stato and San Marino RTV, as well as its function as a gateway to the Eurovision Song Contest and, therefore, they guarantee a personal obligation and undertake, for the entire duration of the Contest, always to maintain behavior and demeanor that are disciplinarily correct, avoiding, through their performance, infringing in any way the rights of third parties.

In particular, the Competitor must report, before or during each performance, but before its end, any and/or possible incompatibility and/or conflict of interest with any of the Jurors, so that ME, possibly consulting RTV and/or the Segreteria di Stato, may evaluate the replacement of the Juror to ensure a totally impartial, transparent and strictly merit‑based evaluation, according to the free and independent artistic assessment of the Jurors.

Failure to make such disclosure constitutes a serious violation of the rules of conduct, resulting in the exclusion/removal of the Competitor.

A Competitor who arrives late to a convocation will be eliminated.

During the performances, without prejudice to Art. 2 letter b, Competitors may not adopt attitudes or movements, or wear clothing and hairstyles in contrast with standards of decency or in violation of laws (of the Republic of San Marino), and in particular concerning the protection of the Emblem of the Republic, or of the rights of third parties; nor may they utter phrases, make gestures, use objects or wear garments bearing references that are even indirectly advertising and/or promotional or detrimental to the image of the Republic of San Marino.

On the occasion of the televised final evening, ME may, at its sole discretion, modify clothing, accessories, hairstyles, gestures and anything else deemed contrary to the values contained in the San Marino RTV Code of Ethics (https://www.sanmarinortv.sm/chi-siamo/azienda/codice-etico-c195/codice-etico-a182741) to which ME refers.

ME also reserves the right to exclude Competitors at any time from the various phases of the Dreaming San Marino Song Contest if they do not comply with these Regulations or if they adopt conduct contrary to the principles of fairness and good faith and/or behavior disrespectful of public decency and morality.

Competitors must pay particular attention to, acknowledge and fully accept the Code of Ethics and the Organizational Model of the television broadcaster that will air the live broadcast.

In particular, it is strictly excluded that anyone may obtain the possibility of moving on to a subsequent phase or even accessing the Final on the basis of agreements with anyone, since, in order to reach the Final, the phases provided for in these Regulations must be passed, by virtue of each Competitor’s merit. For the proper and regular conduct of the Dreaming San Marino Song Contest, Competitors, and, for minors, their parents and/or guardians, now for then, undertake and are obliged to report to ME the presence of individuals who, posing as staff and/or collaborators of the Dreaming San Marino Song Contest, request money or offer services of any kind or propose unlawful agreements to pass the evaluations and/or selection phases and/or to reach the Final directly. Competitors are therefore invited to beware of those who are not listed in the register of Official Collaborators, reporting any abuse to ME.

Failure to make such report, as well as any agreement with such impostors by the Competitor and/or the parents exercising parental authority and/or anyone on behalf of and in the interest of the Competitor and/or said parents, will give ME full right to exclude and remove ex officio the Competitor from the Dreaming San Marino Song Contest, also due to the breach of the relationship of trust, ME also reserving the right to claim compensation for the moral and material damage suffered.

Art. 7 – RIGHTS AND OBLIGATIONS OF THE COMPETITORS

7.1 FEES AND/OR REIMBURSEMENTS

The Competitors unconditionally undertake without any claim to compensation whatsoever. Travel and accommodation expenses and/or any other costs shall be borne by the Competitors, as shall the musical bases (masters).

In the event of failure to hold the Dreaming San Marino Song Contest due to force majeure (e.g., COVID), the Competitors shall be entitled, if requested, only to the refund of the amounts corresponding to the registration fees already paid; for no other reason are refunds envisaged.

Any further claim and/or reason vis‑à‑vis ME and the Dreaming San Marino Song Contest and the entities referred to in the preamble is excluded.

7.2 WITHDRAWALS OR RENUNCIATIONS

Upon signing the registration application, Competitors expressly accept and sign the non‑terminable contractual obligation to indemnify ME for image damage suffered in the event of unjustified failure to participate in the Final if selected among the Finalists, including any participation in the Eurovision Song Contest 2026 and, in the latter case, also the damage suffered by San Marino RTV, competent for registering for the Eurovision Song Contest 2026. Competitors who have withdrawn from previous phases will in any case not be entitled to any refund.

7.3 DISQUALIFICATIONS/REMOVALS

In the event of disqualification, according to ME’s prudent assessment in relation to the Regulations in general, the Competitor ranked immediately thereafter shall take over the rights and prerogatives due to the disqualified Competitor, and so on, all compatible with the timeframes for carrying out the Dreaming San Marino Song Contest and by ME’s non‑appealable decision.

The events provided for in Art. 2 b) and 6) constitute a serious violation of these Regulations, with the consequent right for ME, at its sole discretion, to decide on the disqualification/removal of the Competitor.

7.4 UNDERTAKINGS

By signing these Regulations and participating in the Dreaming San Marino Song Contest, the Competitors undertake, now for then, free of charge and without any fees and/or costs of any kind, to assign to ME the right to film and/or photograph and/or record, including through third‑party authorized subjects, by television, cinematographic, photographic and phonographic means on film, tape or any other medium existing now or invented in the future, their image, voice, name and the artistic performances rendered by them during the entire Dreaming San Marino Song Contest, with ME’s full right to reproduce, distribute, broadcast, make available, duplicate, process, combine, synchronize, print, publish and project the footage and/or photographs and/or recordings, either in full or in part, together with the Dreaming San Marino Song Contest or separately, by any means currently known (by way of example and not limitation: terrestrial TV, satellite, cable, radio, web radio, web TV, social networks, internet, downloading, streaming, analog and/or digital systems, DVB‑T, DVB‑H, DVB‑X, online and offline, fixed and mobile telephony, UMTS, GPRS, HSDPA etc.), or that will be invented in the future, in any form and manner, without any limitation of time and/or space, through websites, web radio, web TV, social networks, etc., including through total and/or partial assignment to third parties.

It is understood that the foregoing assignments are essential for participation in the Dreaming San Marino Song Contest and that this has been taken into account in determining the registration fees (including the free phase), also to remunerate the Competitors on a lump‑sum basis.

7.5 CONDITIONS FOR ACCESS TO THE SEMI‑FINALS

To complete and supplement the provisions of Art. 7.4 (Undertakings) above, it is specified that Competitors selected for the Semi‑Finals undertake, now for then, to:

  1. assign to ME the master of the musical bases that will be used by the Competitors, which must be of their full and exclusive ownership, free of any and all rights (save for SIAE rights in its performance for works protected thereby) for the so‑called related rights of both the phonographic producer and the performers (with specific indemnity by the Competitor, who shall bear such costs exclusively), acknowledging that the Competitor personally holds such rights and that, by participating in the Dreaming San Marino Song Contest, waives any and all indemnities/reimbursements/fees or other, including by way of equitable remuneration, this having been taken into account in determining the registration fee for the Dreaming San Marino Song Contest including the assignment to ME and in view of the free Eligibility Verifications also for such synallagma.

In particular, by such assignment, free of charge and without any fees and/or costs of any kind, and with the right to assign to third parties, of the masters of the musical bases of the works submitted to the Dreaming San Marino Song Contest pursuant to Art. 5 above, the Competitors undertake to assign the so‑called related rights of both the phonographic producer and the performers (with specific indemnity by the Competitor, who shall bear such costs exclusively) and the Competitor, now for then, assuming full responsibility, declares that he/she will deliver the bases/tracks suitable for duplication directly to the production, declaring and warranting that he/she is the sole, exclusive and only holder and owner of all phonographic rights therein, that he/she has obtained the rights from any and all collaborators and right holders, and that he/she may, freely and without prejudice or limitations, transfer the exploitation rights, including, in particular, distribution in any form and manner, making available to the public, recording and all secondary rights in general, to ME, which accepts, and this is an integral part of participation in the Competition, given the determination of the fee, which has also taken into account this essential and non‑derogable, non‑exclusive assignment, for the period from the delivery of the songs (audio masters) until 31/12/2026;

  1. deliver to ME, before the date of the Semi‑Final, the master of the complete bases (music and vocals) of the works submitted to the Dreaming San Marino Song Contest pursuant to Art. 5 above (cover song and original song), in WAVE file format of adequate phonographic quality;
  2. participate in live promotional activities and/or concerts organized in the Republic of San Marino against reimbursement of expenses only, and this until 31/12/2026.

The foregoing obligations and assignments have been taken into account for everything borne by ME in organizing the Dreaming San Marino Song Contest and constitute an essential condition for access to the San Marino Song Contest.

Art. 8 – POWERS OF THE ORGANIZATION

8.1 PROMOTIONAL/ADVERTISING ACTIONS BY THE ORGANIZER AND THE ENTITIES REFERRED TO IN THE PREAMBLE

ME а также RTV shall be entitled to associate with the San Marino Song Contest and/or its television and/or radio broadcast one or more promotional/advertising initiatives, including, by way of example but not limitation: sponsorship operations, teleshopping, sponsorships, merchandising, without any Competitor having anything to claim.

By signing these Regulations, the Competitors undertake, now for then, to grant ME, free of charge, the right to use their image for the promotional/advertising initiatives referred to above, all for a period of four years from the signing of these Regulations, and this has been taken into account in determining the registration fees referred to in Art. 4 above.

8.2 TV, AUDIO AND PHOTO RECORDINGS

ME а также RTV shall be entitled to record and/or film and/or have third parties record and/or film and distribute one or more phases of the San Marino Song Contest, at the television, audiovisual, photographic and phonographic levels. Each Competitor authorizes, by signing the release attached to the registration application, such photographs, recordings and filming, granting the exploitation of his/her image rights connected to his/her public performance and presence at the San Marino Song Contest, also for the purposes of any promotional/advertising operations referred to in the preceding section, without any limitation of time and/or space and without having anything to claim either from ME or from third parties.

ME shall also be entitled to use said photographs for the possible production of a photographic book relating to the San Marino Song Contest, as well as to publish and distribute said photographs, recordings and filming through websites, web radio, web TV and social networks.

ME, in particular, shall be entitled to sub‑license the rights to third parties, in particular to the Segreteria di Stato.

Art. 9 – AMENDMENTS TO THE REGULATIONS

During the period of validity of these Regulations, ME, at its sole discretion, may make additions and amendments thereto for needs evaluated, at ME’s sole discretion, for organizational and functional purposes. ME may also, for unforeseen or supervening events, including potential issues related to Covid, introduce amendments and additions to protect and safeguard the artistic level of the event, while preserving the spirit of the preamble and the structure of the event.

Such additions and amendments shall be deemed fully valid and effective at the time they are published on the Dreaming San Marino Song Contest Website, and therefore all Competitors are required to consult said Website.

Art. 10 – COMMUNICATIONS

All communications, of any kind, provided for in these Regulations will be validly made by publication on the Dreaming San Marino Song Contest Website or by electronic service to the e‑mail addresses indicated by the Competitors in the registration application.

Competitors are therefore required to consult the Dreaming San Marino Song Contest Website, and ME hereby disclaims any liability for any electronic delivery issues, delays or failures.

Art. 11 – ARBITRATION

Any dispute concerning the interpretation and performance of these Regulations shall be settled by submitting a specific appeal to the Arbitral Tribunal.

The interested party must first send to ME a specific registered letter with return receipt setting out the objection within the peremptory term of 10 (ten) days from the moment the event that the party intends to challenge occurred. If ME declares the objections raised by the interested party to be unfounded, the latter must submit to the Arbitral Tribunal, at the seat specified below, a specific appeal within the peremptory term of 5 (five) days from receipt of ME’s registered letter of rejection.

The seat of the Arbitral Tribunal is in San Marino. The Arbitral Tribunal, which shall decide as an amicable composer, without procedural formalities and as expeditiously as possible, shall be composed of three members: one appointed by ME, one by the appellant and one, acting as President, by the Segreteria di Stato.

The judgment of the Arbitral Tribunal shall be final and unappealable.

By accepting these Regulations, the Competitor submits to the decision taken.
