SM 29275 (hereinafter, for brevity, \u201cME\u201d), have agreed to implement a music competition, developed in multiple phases, using digital channels for pre-selection purposes and in-person events within the Republic of San Marino, in order to identify the Winner to be entered, on behalf of San Marino RTV, in the Eurovision Song Contest 2027.<\/p>\n<p>&nbsp;<\/p>\n<p>San Marino RTV, in its capacity as a member of the EBU, has the right to register one Artist for the Eurovision Song Contest, representing the Republic of San Marino.<\/p>\n<p>&nbsp;<\/p>\n<p>The Secretariat of State, in agreement with San Marino RTV, entrusts ME with the organisation of the initial phases of the San Marino Song Contest called \u201cDreaming San Marino Song Contest\u201d (eligibility verification\/registrations, casting, stage &amp; live academy), while San Marino RTV organises and produces the two Semi-Finals and the Final called \u201cSan Marino Song Contest\u201d, also taking care of television broadcasting and of registering the Winner for the Eurovision Song Contest 2027.<\/p>\n<p>&nbsp;<\/p>\n<p>ME has expressed its intention to continue the activities of planning, organising and carrying out the initial phases of the San Marino Song Contest (called \u201cDreaming San Marino Song Contest\u201d). ME is tasked with drafting, for the initial phases of the San Marino Song Contest called \u201cDreaming San Marino Song Contest\u201d, a General Regulation, in line with the Eurovision Song Contest Regulation, setting out and governing the general conditions for registration, the selection conditions and all provisions necessary to ensure the regularity of the phases of the Contest: the Prize for the Winner of the San Marino Song Contest (or for the next ranked participant should the Winner renounce) shall be registration for the Eurovision Song Contest 2027, to be carried out by San Marino RTV.<\/p>\n<p>&nbsp;<\/p>\n<p>San Marino RTV shall, in particular \u2014 in line with the public\u2013private synergy agreement \u2014 be responsible for the technical-artistic direction, production, organisation, administrative management, logistics and distribution:<\/p>\n<ul>\n<li>2 (two) Semi-Finals with the indicative participation of 20 (twenty) competitors each (up to 40 in total);<\/li>\n<li>The Final of the San Marino Song Contest (with television broadcast).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The Secretariat of State and San Marino RTV, together with ME, intend to organise a competition that enables any citizen worldwide, of any nationality and speaking any language, to take part, win and qualify for the Eurovision Song Contest 2027.<\/p>\n<p>&nbsp;<\/p>\n<p>San Marino RTV broadcasts via its single television channel 550 (Digital Terrestrial \u2013 Tiv\u00f9sat \u2013 Sky), as well as via radio and its official digital and social media platforms, ensuring comprehensive, multi-channel coverage of the San Marino Song Contest.<\/p>\n<p>&nbsp;<\/p>\n<p>The procedure for identifying the competitor who will access the Eurovision Song Contest 2027 is divided into two phases: the first called \u201cDreaming San Marino Song Contest\u201d and the subsequent one called \u201cSan Marino Song Contest\u201d, with television coverage, under the aegis and organisation of San Marino RTV, providing for two Semi-Finals and the Final with the proclamation of the Winner.<\/p>\n<p>&nbsp;<\/p>\n<p>These Regulations for the 2026\/2027 edition ME governs the procedures for registration, entry and selection for the stages known as the \u201cDreaming San Marino Song Contest\u201d, which are designed to organise the San Marino Song Contest, the winner of which shall be entitled to represent San Marino at the Eurovision Song Contest 2027, upon nomination by San Marino RTV.<\/p>\n<p>&nbsp;<\/p>\n<p>These Regulations specifically concern the initial phases of the Contest called \u201cDreaming San Marino Song Contest\u201d, organised by ME, which determine the selection of the 40 (forty) competitors admitted to the two Semi-Finals of the San Marino Song Contest, organised and produced by San Marino RTV. The Semi-Finals will select 10 (ten) competitors (5 for each Semi-Final) who will access the Final of the San Marino Song Contest, in which the competitors thus identified will compete publicly together with any artists invited by San Marino RTV. A qualified Jury, appointed by San Marino RTV, will designate the Winner of the San Marino Song Contest, who shall have the right to represent the Republic of San Marino at the Eurovision Song Contest 2027.<\/p>\n<p>&nbsp;<\/p>\n<p>Having set out the foregoing, MEDIA EVOLUTION S.R.L., in accordance with the agreements referred to above and in full agreement with the aforementioned entities, hereby adopts the following RULES for the 2026\/2027 edition of the San Marino Song Contest.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 1 - COMPETITORS<\/h1>\n<p>As of today, all natural persons who, by 01\/05\/2027, have reached the age of eighteen (18) may apply to register for the Dreaming San Marino Song Contest by submitting the relevant registration application (hereinafter \u201cCompetitors\u201d), either as solo performers or as musical groups with a performer (for example, duo, band, etc.). Registrations will end on 25\/01\/2027.<\/p>\n<p>&nbsp;<\/p>\n<p>In the case of minors, the consent to and signature of the registration by the parents exercising parental authority are required; they hereby undertake to cooperate actively in obtaining the authorisation required for minors to perform in the Dreaming San Marino Song Contest, by signing, for this purpose, the consent form and any necessary document and\/or application: the granting of authorisation by the relevant authority is a condition for participation in all stages of the Dreaming San Marino Song Contest.<\/p>\n<p>&nbsp;<\/p>\n<p>The parents (including just one of them where only one is present) and\/or the guardian, if appointed by the competent judicial authority (hereinafter also referred to as the parent), shall be solely responsible for any presence, act and\/or behaviour of their children within the scope of the activities of the San Marino Song Contest, and shall hold ME, San Marino RTV and the Segreteria di Stato harmless.<\/p>\n<p>&nbsp;<\/p>\n<h2>Article 1 BIS \u2013 One Musical Project per Competitor<\/h2>\n<p>&nbsp;<\/p>\n<p>Each competitor \u2013 whether a solo performer, duo, band, or any other formation \u2013 may participate in the Dreaming San Marino Song Contest with <strong>just one musical project<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>Competitors are strictly prohibited from taking part, in any capacity \u2013 including as a singer, instrumentalist, backing vocalist, beatmaker or in any other performing role \u2013 in more than one musical project entered in the Contest.<\/p>\n<p>&nbsp;<\/p>\n<p>By way of example and without limitation, the prohibition applies where:<\/p>\n<ul>\n<li>an artist enters both as a solo performer and as a member of a musical group;<\/li>\n<li>two or more separate musical groups entering the Contest share even one member, in any capacity;<\/li>\n<li>During the Contest, a band or musical group replaces one of its members, for internal reasons, with an artist who is already entered in the Contest as a solo performer and\/or as part of a musical group.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Any breach of this prohibition shall result in the immediate disqualification, in accordance with Article 7.3 below, of all Competitors involved in more than one musical project, without entitlement to any refund of fees paid and without prejudice to ME\u2019s right to seek compensation for any loss suffered.<\/p>\n<p>&nbsp;<\/p>\n<p>ME reserves the right, at any stage of the Competition, to request from entrants documentation sufficient to verify the composition of the musical project.<\/p>\n<p>&nbsp;<\/p>\n<h1>Article 1 ter \u2013 Wild Card for Competitors Resident in San Marino<\/h1>\n<p>All artists resident in the Republic of San Marino may enter the Dreaming San Marino Song Contest and take part in the selection process, as set out in Article 2 below, on the same terms as other entrants.<\/p>\n<p>&nbsp;<\/p>\n<p>If no San Marino competitor is selected to access the final of the San Marino Song Contest referred to in Art. 2, letter e) below, ME shall award, to the highest-ranked among the excluded San Marino competitors, a Wild Card, enabling them to access the final of the San Marino Song Contest directly.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 2 \u2013 The San Marino Song Contest Pathway<\/h1>\n<p>In order to announce the winner of the San Marino Song Contest, contestants must complete the following process:<\/p>\n<p>&nbsp;<\/p>\n<h2>A) \u201cDreaming San Marino Song Contest\u201d phase (under ME\u2019s responsibility)<\/h2>\n<ul>\n<li>Eligibility Verification\/Online Registration on the website https:\/\/dreamingsanmarinosongcontest.com\/ (hereinafter, for brevity, the \u201cWebsite\u201d) with a request for Eligibility Verification;<\/li>\n<li>The casting will take place over the course of one day;<\/li>\n<li>Stage &amp; Live Academy: the training and selection phase for the 40 (forty) contestants who will go through to the 2 (two) semi-finals (20 for each semi-final).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2>B) \u201cSan Marino Song Contest\u201d Phase (under the responsibility of San Marino RTV)<\/h2>\n<ul>\n<li>2 (two) selection Semi-Finals, produced and broadcast by San Marino RTV, upon the outcome of which 5 (five) Competitors from each Semi-Final will progress to the Final;<\/li>\n<li>The final of the San Marino Song Contest, organised and broadcast by San Marino RTV, during which the winner will be proclaimed. The winning song will be entered by San Marino RTV for the Eurovision Song Contest 2027, subject to verification of all eligibility requirements.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>All documentation relating to the Dreaming San Marino Song Contest phase (for which ME is responsible) will be kept on file for 3 (three) months from the end of the Final.<\/p>\n<p>&nbsp;<\/p>\n<h2>a) ELIGIBILITY VERIFICATION \u2013 ONLINE REGISTRATIONS (ME)<\/h2>\n<p>Eligibility Verification is free of charge and is intended solely to verify the eligibility status of each Competitor for the competition through an assessment carried out by an industry expert, selected at ME\u2019s sole discretion, who will issue a positive or negative verdict. It is understood that even in the event of a negative outcome, the Competitor may still register for the Casting.<\/p>\n<p>&nbsp;<\/p>\n<p>Eligibility Verification will commence today, conclude on 17\/01\/2027, and be conducted online by submitting a specific form to ME. This form is available on the Website in the \u201cEligibility Verification: online form\u201d section, through which the required materials (video links and\/or mp3 files) may be sent, as specified in the same section.<\/p>\n<p>&nbsp;<\/p>\n<h2>b) Casting (ME)<\/h2>\n<p>This phase shall take place in San Marino at a venue to be designated by ME, provisionally at the Event Hall of the San Marino Outlet Experience in Falciano, Str. degli Angariari no. 41, and shall consist, provisionally, of several sessions, each lasting 1 (one) day. The sessions will be published on the official website of the Dreaming San Marino Song Contest and shall constitute final notice to the competitors.<\/p>\n<p>&nbsp;<\/p>\n<p>The casting process consists of a selection phase involving a private audition, performed to a live backing track (half-playback), and assessment by the jury accredited and appointed by ME, which will select approximately 240 (two hundred and forty) or more contestants to proceed to the subsequent Stage &amp; Live Academy phase, it being understood that ME reserves the right to determine the exact number. The session will be recorded by ME.<\/p>\n<p>&nbsp;<\/p>\n<p>The Jury\u2019s decision is final. In particular, the Competitor must, including at the time of the casting, formally notify ME of any fact, element, circumstance, relationship or other matter that may, in whole or in part, constitute \u2013 even indirectly \u2013 a cause of influence on the Jury, or any of its members, or anyone within ME\u2019s organisation, on the Jury\u2019s vote, which must be free and based on meritocratic artistic assessments in accordance with the judge\u2019s personal judgement. Any past participation by the Competitor and\/or the judge and\/or a member of the organisation in other competitions or festivals must be disclosed by both the Competitor and the judge to facilitate the judge\u2019s replacement, given the trend of Competitors taking part in multiple competitions and festivals. The foregoing shall apply to all stages of the Dreaming San Marino Song Contest.<\/p>\n<p>&nbsp;<\/p>\n<p>For competitors residing in countries that do not border Italy, casting may be conducted, upon the competitor's request, via remote connection according to the procedures and on the dates that will be determined at ME's sole discretion and communicated to the requesting competitor by electronic mail.<\/p>\n<p>&nbsp;<\/p>\n<p>For the sake of clarity, the countries bordering Italy are: Switzerland, France, Austria and Slovenia.<\/p>\n<p>&nbsp;<\/p>\n<h2>c) Stage &amp; Live Academy (ME)<\/h2>\n<p>The Stage &amp; Live Academy (also \u201cLA\u201d) will be held in four sessions, starting from February 2027, according to a calendar published at ME\u2019s sole discretion on the Dreaming San Marino Song Contest Website. The final session will conclude on 25\/02\/2027. It is reiterated that all will take place according to a calendar that will be decided at ME\u2019s sole discretion and communicated to the Competitors by publication on the Website in the dedicated \u201cStage &amp; Live Academy\u201d section.<\/p>\n<p>&nbsp;<\/p>\n<p>The LAs are aimed at the performance of the Competitor before the Jury, chosen at ME's sole discretion, after the Academy. The Jury will judge and evaluate the participants and their song.<\/p>\n<p>&nbsp;<\/p>\n<p>There shall be 8 (eight) heats, each comprising approximately 30 (thirty) competitors; from each heat, 5 (five) competitors will advance to the Semi-Finals. The total number of competitors admitted to the two Semi-Finals referred to in paragraph d) below shall be 40 (forty), i.e., 20 (twenty) for each Semi-Final.<\/p>\n<p>&nbsp;<\/p>\n<h2>d) Semi-Finals (San Marino RTV)<\/h2>\n<p>Phase reserved for Competitors selected by the Jury at the outcome of the LAs.<\/p>\n<p>&nbsp;<\/p>\n<p>The Semi-Finals will be held in San Marino.<\/p>\n<p>&nbsp;<\/p>\n<p>Competitors will compete against each other, on a live backing track (half playback) before the public and a qualified Jury composed of industry experts chosen at the sole discretion of San Marino RTV, which produces and broadcasts the two Semi-Finals.<\/p>\n<p>&nbsp;<\/p>\n<p>The Jury's evaluation is final, given and publicly reasoned at the end of the performance, based on criteria of artistic merit, originality and interpretative-executive ability of each Competitor. There are 2 (two) Semi-Finals.<\/p>\n<p>&nbsp;<\/p>\n<p>The Jury will determine those admitted to the Final. The Competitors selected from the Semi-Finals will participate in the Final, during which they will compete among themselves and with Artists invited and selected by San Marino RTV. The Jury will admit to the Final approximately 10 (ten) Competitors, i.e., 5 (five) Competitors for each of the two Semi-Finals.<\/p>\n<p>&nbsp;<\/p>\n<p>It is understood, and all parties acknowledge, that minors may not perform in either the Semi-Finals or the Final after 24:00; therefore, in the event that the Competitor passes the initial selection phases provided for, he\/she may not participate in the subsequent ones if they are after the aforementioned 24:00; in such an event, audio-visual recordings of the Competitor will be used.<\/p>\n<p>&nbsp;<\/p>\n<h2>e) Final of the San Marino Song Contest (San Marino RTV)<\/h2>\n<p dir=\"auto\">The Final will take place at the Teatro Nuovo Dogana or at another venue decided by San Marino RTV in agreement with ME.<\/p>\n<p>&nbsp;<\/p>\n<p>The date of the Final may be changed for reasons of San Marino RTV's non-appealable scheduling needs.<\/p>\n<p>&nbsp;<\/p>\n<p>10 (ten) competitors (5 for each semi-final) will qualify for the final, in addition to any San Marino competitor referred to in Article 1 bis.<\/p>\n<p>&nbsp;<\/p>\n<h2>(f) Competitors selected by San Marino RTV<\/h2>\n<p>San Marino RTV reserves the right to select, at its sole and final discretion, up to a maximum of 10 (ten) Competitors for projects of particular artistic and musical significance and interest.<\/p>\n<p>&nbsp;<\/p>\n<p>If, at San Marino RTV\u2019s discretion, one or more of the aforementioned Competitors are selected, they may access the Final \u2014 in addition to the 10 (ten) Finalists identified under paragraph e) above and any San Marino Competitor referred to in Art. 1 BIS \u2014 without having to participate in the preceding phases of the San Marino Song Contest, subject to the obligation to register and to accept these Regulations in full.<\/p>\n<p>&nbsp;<\/p>\n<p>To facilitate the performance of Finalist Competitors who access the Final as multi-member Competitors and\/or as a musical group with one or more performers (for example, a duo, band, etc.), San Marino RTV may, by way of exception and where particular needs arise, assessed freely and without restriction by San Marino RTV, authorise a mixed performance (live and backing track) using, during the live performance on the Final stage, a prerecorded audio\/video contribution from one member, all in accordance with the rules of the Eurovision Song Contest 2027.<\/p>\n<p>&nbsp;<\/p>\n<p>An essential condition for accessing the Final is the full, non-negotiable and non-disputable execution, within 3 (three) days from the conclusion of the Semi-Finals, of all statements of warranty concerning solvency and project capacity (in the event of victory) for participation in the Eurovision Song Contest 2027; Competitors must demonstrate adequate financial capacity and the availability of a high-quality phonographic and publishing company, or, for self-productions, project conditions of quality and concrete feasibility, as agreed between San Marino RTV and the Segreteria di Stato.<\/p>\n<p>&nbsp;<\/p>\n<p>A competitor deemed unsuitable may not take part in the final.<\/p>\n<p>&nbsp;<\/p>\n<p>ME may submit to the Competitor a contractual proposal (subject to a successful outcome) aimed at ensuring financial viability and the quality of the project to enable proper participation in the Eurovision Song Contest 2027; such proposal must be accepted and signed by the Competitor and\/or the authors of the competing song and\/or the producers and\/or any rights holder, by 28 February 2027 at the latest, failing which the right to participate in the Final will be forfeited.<\/p>\n<p>&nbsp;<\/p>\n<p>In the Final, competitors must perform the same original song they performed in the Semi-Finals.<\/p>\n<p>&nbsp;<\/p>\n<p>The Winner will be proclaimed by a Jury of experts composed of 5 (five) members chosen at the sole discretion of San Marino RTV (one of whom shall serve as President).<\/p>\n<p>&nbsp;<\/p>\n<p>The winner of the San Marino Song Contest, with the song performed at the Final, will be registered by San Marino RTV for the Eurovision Song Contest 2027, subject to verification of all eligibility requirements.<\/p>\n<p>&nbsp;<\/p>\n<p>The winner of the San Marino Song Contest agrees, both for themselves and on behalf of third parties, now and in the future, to sign and ensure the signing of all documents necessary for participation in the Eurovision Song Contest 2027. This constitutes full acceptance and acknowledgement, with the obligation of complete and total performance, including the 2027 license agreement between the rights holder of the audio-video recording of the song performed at the Final and the phonographic company selected by the Eurovision Song Contest. This agreement will be published on the Website for the competitors\u2019 full awareness. Competitors hereby confirm that they have taken note of the 2026 license, which will be applicable for 2027, and that its execution is a prerequisite for participation in the Final of the San Marino Song Contest.<\/p>\n<p>&nbsp;<\/p>\n<p>The winner of the San Marino Song Contest undertakes, also on behalf of third parties, both now and in the future, to comply with all the rules, commitments, and conditions set out in the Eurovision Song Contest 2027 Regulations.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 3 \u2013 Registration for the Dreaming San Marino Song Contest<\/h1>\n<p>All those who meet the requirements set out in Article 1 may register for the San Marino Song Contest from today until 25\/01\/2027, regardless of whether they have carried out the (non-binding) Eligibility Verification. All registration forms are published on the Dreaming San Marino Song Contest Website in the \u201cRegistrations\u201d section.<\/p>\n<p>&nbsp;<\/p>\n<p>Incomplete\/unsigned applications or those lacking proof of payment of the fees will not be accepted. For minors, in addition to their own registration, the signature of the parents exercising parental authority is required.<\/p>\n<p>&nbsp;<\/p>\n<h2>3.1 Casting (ME)<\/h2>\n<p>All those who wish to register for the Casting phase, whether in person or via remote connection if the conditions set forth in Art. 1 above apply, must submit the relevant registration application, after payment of the registration fee set at:<\/p>\n<ul>\n<li>\u20ac150.00 (one hundred and fifty euros\/00), including VAT, for both individuals and groups;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Payment of the registration fees, which is an essential condition of registration, may be made by bank transfer to the account of Media Evolution S.r.l.:<\/p>\n<ul>\n<li>Account Holder: MEDIA EVOLUTION S.R.L.<\/li>\n<li>IBAN: SM97V0328709801000010314343<\/li>\n<li>SWIFT \/ BIC: BSDISMSDXXX<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Note for transfers from the SEPA area (European Union): San Marino is part of the SEPA area; therefore, the transfer can be made as a standard SEPA transfer, with no additional international fees, by selecting San Marino (SM) as the country.<\/p>\n<p>&nbsp;<\/p>\n<h2>3.2 Stage &amp; Live Academy (ME)<\/h2>\n<p>All those who obtained a positive outcome from the Casting phase may register for the subsequent Stage &amp; Live ACADEMY phase, within and no later than 3 (three) days from the aforementioned assessment and by paying the fee of Euro 150.00 (Euro one hundred and fifty\/00), including VAT, which constitutes a condition thereof.<\/p>\n<p>&nbsp;<\/p>\n<p>If registration is not completed within the aforementioned 3 (three)-day period, the Competitor forfeits the possibility of registering for the Stage &amp; Live ACADEMY phase.<\/p>\n<p>&nbsp;<\/p>\n<p>For citizens and groups from San Marino, there is a single registration fee of \u20ac50.00 (fifty euros\/00), provided that registration is completed by the deadline of 25 January 2027.<\/p>\n<p>&nbsp;<\/p>\n<p>The registration application for the Stage &amp; Live ACADEMY phase is published on the Contest website and payment of the provided fee, which constitutes a condition of validity, must be made to ME\u2019s bank account.<\/p>\n<p>&nbsp;<\/p>\n<h2>3.3 Semi-finals \/ Final (San Marino RTV)<\/h2>\n<p>No registration fee is envisaged for the Semi-Finals phase and none for the Final.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 4 \u2013 Musical Works<\/h1>\n<p>At the time of participation in each phase of the Contest, the Competitor shall deliver 2 (two) songs and, for each of these, the instrumental backing tracks (instrumental only) and, for the same songs, also 2 (two) complete backing tracks (music and vocals) with a maximum duration of 3 (three) minutes.<\/p>\n<p>&nbsp;<\/p>\n<p>The backing tracks (half playback) must be supplied in WAVE file format of sufficient quality, specifying the competitor\u2019s first name and surname, as well as the titles of the songs submitted and their order of performance.<\/p>\n<p>&nbsp;<\/p>\n<p>By signing these Regulations, the Competitor agrees that the backing tracks submitted to ME will not be returned and will be deleted and\/or destroyed once the Contest has ended.<\/p>\n<p>&nbsp;<\/p>\n<p>It is understood that, as the purpose of the Contest is to select the Winner who will represent San Marino RTV at the Eurovision Song Contest 2027, the aforementioned songs must be consistent with that purpose.<\/p>\n<p>&nbsp;<\/p>\n<h2>4.1 Casting<\/h2>\n<p>The songs may be 2 (two), in a language freely chosen by the Competitor, on a half-playback backing track freely chosen by the Competitor. The duration of each song on a half-playback backing track may not exceed 3 (three) minutes and, if longer, may be faded out during the audition.<\/p>\n<p>&nbsp;<\/p>\n<h2>4.2 Stage &amp; Live Academy<\/h2>\n<p>There shall be only one song, in a language freely chosen by the Competitor, and it must mandatorily be the original song (Art. 5) intended to be submitted to the Eurovision Song Contest 2027. The total duration of the performance, on half-playback, must not exceed 3 (three) minutes maximum (the duration envisaged for Eurovision Song Contest songs) and, if longer, will result in the exclusion of the Competitor.<\/p>\n<p>&nbsp;<\/p>\n<h2>4.3 Semi-Finals\/Final<\/h2>\n<p>There shall be only one song, and it must be the original song performed at the Stage &amp; Live ACADEMY. The live performance must not exceed 3 (three) minutes in total (the duration stipulated for Eurovision Song Contest entries); if it exceeds this limit, the contestant will be disqualified.<\/p>\n<p>&nbsp;<\/p>\n<h1>Article 5 \u2013 Definition of Cover and Original Song<\/h1>\n<h2>Cover Song<\/h2>\n<p>A cover song means a musical work previously performed and published by another artist of clear renown who is the original performer. \u2018Published\u2019 means a song presented and used in any form and\/or manner, including making it available to the public, even free of charge (e.g., on the internet), and\/or used in another competition.<\/p>\n<p>&nbsp;<\/p>\n<h2>B) Original Song \u2014 Definition and Requirements<\/h2>\n<p>For the purposes of these Regulations, an original song means a song that, as at 1 September 2026 (or such later date as may be established by the EBU Regulations, which shall in that event prevail pursuant to this Article), cumulatively meets all of the following conditions:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>Has never been published<\/strong>, in any form or by any means, including \u2014 by way of example and without limitation \u2014 digital distribution, streaming platforms (Spotify, Apple Music, Amazon Music, Tidal, Deezer, etc.), paid or free downloads, YouTube, SoundCloud, Bandcamp, TikTok, Instagram Reels, or any other website or social network;<\/li>\n<li><strong>Has never been broadcast<\/strong> via radio, television, podcast or any other analogue or digital means of public dissemination;<\/li>\n<li><strong>Never been performed publicly<\/strong> by the Competitor or any other artist, at concerts, live events, showcases or any other public event open to paying or non-paying audiences;<\/li>\n<li><strong>Has never been used in any other music competition or festival<\/strong>, at any national or international level;<\/li>\n<li><strong>It is not available in any form of recording accessible to the public<\/strong>, including amateur recordings uploaded to digital platforms.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>For the purposes of this definition, strictly private sharing that is not accessible to the public (for example, direct submission to producers or record labels in the context of confidential negotiations) shall not constitute publication, provided that the song is neither indexed nor retrievable via search engines or public platforms.<\/p>\n<p>&nbsp;<\/p>\n<p>The definition of an original song shall be interpreted in full compliance with the rules of the Eurovision Song Contest established by the European Broadcasting Union (EBU) and approved by the Reference Group. If the EBU Regulations set a reference date for the definition of an original song that is later than 1 September 2026, or impose more restrictive conditions than those listed above, such EBU provisions shall automatically take precedence and shall be incorporated into these Regulations without the need for further formal amendments.<\/p>\n<h1>Art. 6 \u2013 Conduct<\/h1>\n<p>The Competitors acknowledge the significant importance of the Contest, which involves the Segreteria di Stato and San Marino RTV, as well as its function as a gateway to the Eurovision Song Contest and, therefore, they guarantee a personal obligation and undertake, for the entire duration of the Contest, always to maintain behavior and demeanor that are disciplinarily correct, avoiding, through their performance, infringing in any way the rights of third parties.<\/p>\n<p>&nbsp;<\/p>\n<p>In particular, the Competitor must report, before or during each performance, but before its conclusion, any and\/or possible incompatibility and\/or conflict of interest with any of the Jurors, so that I, possibly in consultation with RTV and\/or the Segreteria di Stato, may evaluate the replacement of the Juror to ensure a totally impartial, transparent, and strictly merit-based evaluation, in accordance with the free and independent artistic assessment of the Jurors.<\/p>\n<p>&nbsp;<\/p>\n<p>Failure to make such disclosure constitutes a serious violation of the rules of conduct, resulting in the exclusion\/removal of the Competitor.<\/p>\n<p>&nbsp;<\/p>\n<p>A competitor who arrives late to a convocation will be eliminated.<\/p>\n<p>&nbsp;<\/p>\n<p>During the performances, without prejudice to Art. 2 letter b, Competitors may not adopt attitudes or movements, or wear clothing and hairstyles in contrast with standards of decency or in violation of laws (of the Republic of San Marino), and in particular concerning the protection of the Emblem of the Republic, or of the rights of third parties; nor may they utter phrases, make gestures, use objects or wear garments bearing references that are even indirectly advertising and\/or promotional or detrimental to the image of the Republic of San Marino.<\/p>\n<p>&nbsp;<\/p>\n<p>On the occasion of the televised final, ME may, at its sole discretion, modify clothing, accessories, hairstyles, gestures and anything else deemed contrary to the values set out in the San Marino RTV Code of Ethics (https:\/\/www.sanmarinortv.sm\/chi-siamo\/azienda\/codice-etico-c195\/codice-etico-a182741), to which ME refers.<\/p>\n<p>&nbsp;<\/p>\n<p>ME also reserves the right to exclude contestants at any time from the various stages of the Dreaming San Marino Song Contest if they fail to comply with these Rules or if they engage in conduct contrary to the principles of fairness and good faith and\/or behaviour that is contrary to public decency and morality.<\/p>\n<p>&nbsp;<\/p>\n<p>Competitors must pay particular attention to, acknowledge and fully accept the Code of Ethics and the Organisational Model of the television broadcaster that will air the live broadcast.<\/p>\n<p>&nbsp;<\/p>\n<p>In particular, it is strictly prohibited for anyone to gain the opportunity to progress to a subsequent stage or even to reach the Final on the basis of agreements with any other party, since, in order to reach the Final, the stages set out in these Rules must be passed on the basis of each Competitor\u2019s own merit. To ensure the proper and orderly conduct of the Dreaming San Marino Song Contest, Competitors \u2013 and, in the case of minors, their parents and\/or guardians \u2013 hereby undertake and are obliged to report to ME the presence of individuals who, posing as staff and\/or collaborators of the Dreaming San Marino Song Contest, request money or offer services of any kind or propose unlawful agreements to pass the evaluation and\/or selection stages and\/or to reach the Final directly. Competitors are therefore urged to be wary of anyone not listed in the register of Official Collaborators and to report any abuse to ME.<\/p>\n<p>&nbsp;<\/p>\n<p>Failure to make such a report, as well as any agreement with such impostors by the Competitor and\/or the parents exercising parental authority and\/or anyone acting on behalf of and in the interests of the Competitor and\/or the said parents, shall entitle ME to exclude and remove the Competitor from the Dreaming San Marino Song Contest of its own accord, also on the grounds of a breach of trust; ME also reserves the right to claim compensation for the moral and material damage suffered.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 7 \u2013 Rights and Obligations of Competitors<\/h1>\n<h2>7.1 Fees and\/or Reimbursements<\/h2>\n<p>The Competitors undertake unconditionally and without any claim for compensation whatsoever. Travel and accommodation expenses and\/or any other costs shall be borne by the Competitors, as shall the backing tracks (masters).<\/p>\n<p>&nbsp;<\/p>\n<p>In the event that the Dreaming San Marino Song Contest cannot be held due to force majeure (e.g. COVID), competitors shall be entitled, upon request, only to a refund of the amounts corresponding to the registration fees already paid; refunds are not provided for any other reason.<\/p>\n<p>&nbsp;<\/p>\n<p>Any further claim and\/or ground against ME, the Dreaming San Marino Song Contest and the entities referred to in the preamble is excluded.<\/p>\n<p>&nbsp;<\/p>\n<h2>7.2 Withdrawals or Waivers<\/h2>\n<p>By signing the registration form, Competitors expressly accept and undertake the non-terminable contractual obligation to indemnify ME for any damage to its reputation suffered in the event of an unjustified failure to take part in the Final if selected as one of the Finalists, including any participation in the Eurovision Song Contest 2027 and, in the latter case, also the damage suffered by San Marino RTV, which is responsible for registration for the Eurovision Song Contest 2027. Competitors who have withdrawn from previous stages will in any case not be entitled to any refund.<\/p>\n<p>&nbsp;<\/p>\n<h2>7.3 Disqualifications\/Removals<\/h2>\n<p>In the event of disqualification, in accordance with ME\u2019s prudent assessment of the Regulations as a whole, the Competitor ranked immediately below shall assume the rights and privileges due to the disqualified Competitor, and so on, subject to the timeframes for the Dreaming San Marino Song Contest and by ME\u2019s final decision.<\/p>\n<p>&nbsp;<\/p>\n<p>The conduct referred to in Articles 1 bis (one-project rule), 2(b) (duty to disclose conflicts of interest with a juror) and 6 (duty to comply with rules and codes of ethics; duty to report incompatibilities or impostors; late submission) constitutes a serious breach of these Regulations, entitling ME, at its sole discretion, to disqualify or remove the Competitor.<\/p>\n<p>&nbsp;<\/p>\n<h2>7.4 Undertakings<\/h2>\n<p>By signing these Regulations and taking part in the Dreaming San Marino Song Contest, the Competitors undertake, both now and in the future, free of charge and without any fees and\/or costs of any kind, to grant ME the right to film and\/or photograph and\/or record \u2013 including through authorised third parties \u2013 by television, cinematographic, photographic and phonographic means on film, tape or any other medium existing now or invented in the future, their image, voice, name and the artistic performances rendered by them throughout the entire Dreaming San Marino Song Contest, with ME having the full right to reproduce, distribute, broadcast, make available, duplicate, process, combine, synchronise, print, publish and project the footage and\/or photographs and\/or recordings, either in full or in part, together with the Dreaming San Marino Song Contest or separately, by any means currently known (by way of example and not limitation: terrestrial TV, satellite, cable, radio, web radio, web TV, social media, the internet, downloading, streaming, analogue and\/or digital systems, DVB-T, DVB-H, DVB-X, online and offline, fixed and mobile telephony, UMTS, GPRS, HSDPA etc.), or any means yet to be invented, in any form and manner, without any limitation of time and\/or space, via websites, web radio, web TV, social media, etc., including through total and\/or partial assignment to third parties.<\/p>\n<p>&nbsp;<\/p>\n<p>It is understood that the above commitments are essential for participation in the Dreaming San Marino Song Contest and that this has been taken into account when setting the registration fees (including the free phase), partly to remunerate the Competitors on a lump-sum basis.<\/p>\n<p>&nbsp;<\/p>\n<h2>7.5 Conditions for Qualifying for the Semi-Finals<\/h2>\n<p>To supplement the provisions of Article 7.4 (Undertakings) above, it is hereby specified that Competitors selected for the Semi-Finals undertake, both now and in the future, to:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>assign to ME the master of the backing tracks to be used by the Competitors, which must be wholly and exclusively owned by them, free from any and all rights (except for SIAE rights relating to the performance of works protected by it) in respect of the so-called related rights of both the phonographic producer and the performers (with specific indemnity by the Competitor, who shall bear such costs exclusively), acknowledging that the Competitor personally holds such rights and that, by participating in the Dreaming San Marino Song Contest, waives any and all indemnities, reimbursements, fees or other payments, including equitable remuneration, this having been taken into account in determining the registration fee for the Dreaming San Marino Song Contest, including the assignment to ME, and in view of the free Eligibility Verifications also in respect of such consideration.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>In particular, by virtue of such assignment, free of charge and without any fees and\/or costs of any kind, and with the right to assign to third parties, of the masters of the backing tracks of the works submitted to the Dreaming San Marino Song Contest in accordance with Article 5 above, the Competitors undertake to assign the so-called related rights of both the phonographic producer and the performers (with specific indemnity by the Competitor, who shall bear such costs exclusively) and the Competitor, now and in the future, assuming full responsibility, declares that he\/she will deliver the backing tracks suitable for duplication directly to the production company, declaring and warranting that he\/she is the sole, exclusive and only holder and owner of all phonographic rights therein, that he\/she has obtained the rights from any and all collaborators and rights holders, and that he\/she may, freely and without prejudice or limitations, transfer the exploitation rights, including, in particular, distribution in any form and manner, making available to the public, recording and all secondary rights in general, to ME, which accepts this, and this forms an integral part of participation in the Competition, given that the fee has been determined, taking into account this essential, non-waivable and non-exclusive assignment, for the period from the delivery of the songs (audio masters) until 31 December 2027;<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>to provide ME, before the date of the Semi-Final, with the master recordings of the complete backing tracks (music and vocals) for the entries submitted to the Dreaming San Marino Song Contest in accordance with Article 5 above (cover version and original song), in WAVE file format of adequate phonographic quality;<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ul>\n<li>take part in live promotional events and\/or concerts organised in the Republic of San Marino on a cost-reimbursement basis only, until 31 December 2027.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The above obligations and undertakings have been taken into account in relation to all costs incurred by ME in organising the Dreaming San Marino Song Contest and constitute an essential condition for entry to the San Marino Song Contest.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 8 \u2013 Powers of the Organisation<\/h1>\n<h2>8.1 Promotional and advertising activities carried out by the Organiser and the entities referred to in the Preamble<\/h2>\n<p>ME and RTV shall be entitled to link one or more promotional or advertising initiatives to the San Marino Song Contest and\/or its television and\/or radio broadcast, including, by way of example but not limited to: sponsorship activities, teleshopping, endorsements and merchandising, without any Competitor having any grounds for complaint.<\/p>\n<p>&nbsp;<\/p>\n<p>By signing these Regulations, the Competitors undertake, both now and in the future, to grant ME, free of charge, the right to use their image for the promotional and advertising initiatives referred to above, for a period of four years from the date of signing these Regulations; this has been taken into account in determining the entry fees referred to in Article 4 above.<\/p>\n<p>&nbsp;<\/p>\n<h2>8.2 TV, Audio and Photographic Recordings<\/h2>\n<p>ME and RTV shall be entitled to record and\/or film and\/or have third parties record and\/or film and distribute one or more stages of the San Marino Song Contest, in television, audiovisual, photographic and phonographic formats. Each Competitor authorises, by signing the release form attached to the registration application, such photographs, recordings and filming, thereby granting the right to use their image rights in connection with their public performance and presence at the San Marino Song Contest, including for the purposes of any promotional or advertising activities referred to in the preceding section, without any limitation in terms of time and\/or place and without being entitled to make any claim against either ME or third parties.<\/p>\n<p>&nbsp;<\/p>\n<p>ME shall also be entitled to use the said photographs for the possible production of a photography book relating to the San Marino Song Contest, as well as to publish and distribute the said photographs, recordings and footage via websites, web radio, web TV and social media.<\/p>\n<p>&nbsp;<\/p>\n<p>I, in particular, shall be entitled to sub-license the rights to third parties, in particular to the Segreteria di Stato.<\/p>\n<p>&nbsp;<\/p>\n<h1>Art. 9 \u2013 Amendments to the Regulations<\/h1>\n<p>During the period of validity of these Regulations, ME, at its sole discretion, may make additions and amendments thereto for needs evaluated, at ME\u2019s sole discretion, for organisational and functional purposes. ME may also, for unforeseen or supervening events, including potential issues related to Covid, introduce amendments and additions to protect and safeguard the artistic level of the event, while preserving the spirit of the preamble and the structure of the event.<\/p>\n<p>&nbsp;<\/p>\n<p>Such additions and amendments will be considered fully valid and effective from the time they are published on the Dreaming San Marino Song Contest Website, and therefore all Competitors are required to consult the said Website.<\/p>\n<p>&nbsp;<\/p>\n<h1>Article 10 \u2013 Communications<\/h1>\n<p>All communications, of any kind, provided for in these Regulations will be validly made by publication on the Dreaming San Marino Song Contest Website or by electronic service to the e-mail addresses indicated by the Competitors in the registration application.<\/p>\n<p>&nbsp;<\/p>\n<p>Competitors are therefore required to consult the Dreaming San Marino Song Contest Website, and ME hereby disclaims any liability for any electronic delivery issues, delays or failures.<\/p>\n<p>&nbsp;<\/p>\n<h1>Article 11 \u2013 Arbitration<\/h1>\n<p>Any dispute concerning the interpretation and performance of these Regulations shall be settled by submitting a specific appeal to the Arbitral Tribunal.<\/p>\n<p>&nbsp;<\/p>\n<p>The interested party must first send to ME a specific registered letter with return receipt outlining the objection within the peremptory period of 10 (ten) days from the occurrence of the event that the party intends to challenge. If ME declares the objections raised by the interested party to be unfounded, the latter must submit to the Arbitral Tribunal, at the seat specified below, a specific appeal within the peremptory period of 5 (five) days from receipt of ME\u2019s registered letter of rejection.<\/p>\n<p>&nbsp;<\/p>\n<p>The seat of the Arbitral Tribunal is in San Marino.
